Proof of work-related facts

“Inspection and verification of the affairs entrusted by the law” involves the issuance of “certificate of fact of interest-relationship” to persons with interests for the inspection of other people’s resident registration cards, issuance of copies or abstracts of resident registration pursuant to the provisions of Article 18 of the Resident Registration Act (inspection or issuance of copies and abstracts), but this is the task of a general administrative attorney only.

However, foreign language Certified Public Translators may issue “fact certificates” and “translation confirmation certificates” related to their work in accordance with Article 28 of the Administrative Judicial Act.

Article 2, Paragraph 1 of the Administrative Attorney Act

Article 2, Paragraph 1 of the Administrative Attorney Act stipulates that “Administrative Attorneys shall conduct the affairs of the following paragraphs in exchange for fees under commission by others.

Among the above duties, the duties of general administrative attorneys, foreign language Certified Public Translators, and technical administrative attorneys are all included, so foreign language translation duties are explained by “paragraph”.

Detailed Regulations

The preparation of documents submitted to administrative agencies shall be the job of a general administrative scrivener or technical administrative scrivener. However, as an exception, when translating documents issued by a foreign government agency to register a marriage, report a death, etc., a foreign language translation administrative scrivener (Certified Public Translator) can also submit the documents to the administrative agency.

“Translation of documents related to the work of administrative agencies” is the work of foreign language translation administrators only. Therefore, general administrators and technical administrators cannot perform the translation stipulated in subparagraph 3. “Documents related to the work of administrative agencies” refer to documents submitted to administrative agencies and documents issued by administrative agencies. Therefore, if general administrators, technical administrators, and the general public translate other people’s “documents related to the work of administrative agencies, they will be punished under Article 35 of the Administrative Judicial Act.

Documents written or translated by a foreign language translation administrator can be submitted directly by the foreign language translation administrator.

Agency activities such as reports, applications, and requests submitted to administrative agencies such as authorization, permission, and license related to the translation of foreign documents are the tasks of a foreign language translation administrator.

Foreign language translation administrators can provide consultation or advice on laws and administration related to foreign administrative work. For example, a foreign language translation administrator can provide consultation and advice on family register relations under the Foreign Relations Act.

The “factual investigation and confirmation of affairs entrusted by law” includes the inspection of another person’s resident registration table and the issuance of a copy or extract of the resident registration table to an interested person pursuant to the provisions of Article 18 of the Resident Registration Act (inspection or issuance of copies or extracts). For this purpose, there are tasks such as issuing a “certificate of fact of interest”, but this is a task only for general administrators.

However, foreign language translation administrators may issue “Fact Certificates” and “Translation Confirmation Certificates” related to their work in accordance with the provisions of Article 28 of the Administrative Judiciary Act.

Translation of documents other than those related to the work of administrative agencies Translation of books, trade documents, personal letters, etc. other than “documents related to the work of administrative agencies” is not restricted by the Administrative Judicial Act, so anyone can freely translate them. . However, in accordance with Article 11 of the Administrative Judiciary Act, “an Foreign Language Translation Administrators (Certified Public Translators) can issue a translation confirmation certificate for the translation he or she has translated.”
